Defendant’s BMW rear ended Plaintiff’s SUV in a low impact motor vehicle accident. Plaintiff claimed $21,572.57 in medical bills and asked for $160,000 in general damages. Prior to trial to avoid further litigation, Defendant offered Plaintiff $35,000 plus $8,000 PIP. The offer was rejected, as they would not accept less than $50,000 plus PIP.
At trial, partner Josh Hayward called a medical expert who testified that, at most, only three months of treatment were related to the accident. The jury agreed and awarded only $5,461.00 in economic damages and $3,500 in non-economic damages.
