The Background

In the prosecution of a breach of a noncompetition agreement and misappropriation of trade secret lawsuit on behalf of a client, a national automobile industry product and service provider, Smith Freed Eberhard obtained a temporary restraining order (TRO) and then a preliminary injunction against its unfairly-competing former salesman. Following those orders, the defense continued to obtain subsequent contempt sanctions for continued violations of the injunctions.

This was all accomplished despite the wrongdoing former employee’s attempt to hide his tracks by destroying electronic evidence.
