The Background
In the prosecution of a breach of a noncompetition agreement and misappropriation of trade secret lawsuit on behalf of a client, a national automobile industry product and service provider, Smith Freed Eberhard obtained a temporary restraining order (TRO) and then a preliminary injunction against its unfairly-competing former salesman. Following those orders, the defense continued to obtain subsequent contempt sanctions for continued violations of the injunctions.
The Outcome
Ultimately, Smith Freed Eberhard obtained a favorable confidential settlement that included a permanent injunction (including a confession of judgment) against the former salesman. This was all accomplished despite the wrongdoing former employee’s attempt to hide his tracks by destroying electronic evidence.
