Paul E. Sheely, Associate

Professional Experience
Paul recently returned to Smith Freed’s Construction Defect Practice Group where he had worked as an Associate from 2000-2003. Paul’s practice focuses on defending General Contractors, Real Estate Developers and Specialty Subcontractors in construction defect related litigation. Paul’s practice is almost evenly split between Oregon and Washington cases.

Over the past 14 years of his practice Paul has also gained experience at a specialty construction litigation firm defending design professionals in malpractice claims, a construction litigation plaintiff’s firm where he represented building owners in construction related claims against builders and six years at a general practice firm where his practice included a wide range of civil litigation both at the trial and appellate level and criminal defense. Paul has experience in all phases of pre trial practice, trial practice and appellate work.

Prior to attending law school Paul worked in the industrial construction industry as a Construction Engineer and as a Project Manager on large industrial and commercial construction projects.

Significant Representations
  • Appellate litigation surrounding interpretation and application of Washington’s Notice of Construction Defect Statute.
  • Successful Appeal based in improper jury instruction as to the measure of damages for injury to real property resulting in reversal of large award in fire loss case.
  • Successful defense of numerous dispositive motions relation to interpretation of the “Economic Loss Rule” in Oregon.
